Welcome to RM Support. These Terms of Use (“Terms”) constitute a legally binding agreement between you and RM Support regarding your access to and use of our website and our services, including home health support and medically tailored meal (MTM) delivery for Medicaid members.

By accessing our website or utilizing our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of our website and services.

Acceptance of Terms
 

By visiting this website, creating an account, or receiving services from RM Support, you represent and warrant that:

  • You are at least 18 years of age and a resident of the State of New York.

  • You possess the legal authority to enter into these Terms.

  • You will comply with all applicable New York State and Federal laws, including Medicaid program integrity rules.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the revised Terms.
 

Eligibility and Medicaid-Based Services
 

RM Support provides services that may be covered by New York Medicaid, Managed Care Organizations (MCOs), or other third-party payors.

  • Clinical Criteria: Eligibility is determined by your specific health plan’s clinical guidelines and the New York State Department of Health (DOH).

  • No Guarantee of Coverage: Approval, denial, or limitations on services (including meal frequency or duration) are determined solely by your payor, not RM Support.

  • Accuracy of Information: You must provide accurate insurance and health information. Providing false information may constitute Medicaid fraud and lead to termination of services.

  • Benefit Changes: If your NY Medicaid eligibility lapses or your health plan changes, RM Support is not obligated to provide unreimbursed services.
     

Use of Our Services
 

Our services include medically tailored meals, nutritional groceries, and home health support as authorized by your plan.

  • Authorized User: Services are provided exclusively for the approved member.

  • Prohibited Conduct: You shall not sell, trade, or transfer meals, groceries, or medical appliances to any other person.

  • Safety & Handling: You are responsible for following all food safety, storage, and heating instructions provided with deliveries to prevent foodborne illness.
     

SMS and Text Messaging Communications
 

By providing your mobile phone number and opting in to receive messages, you agree to the following regarding our SMS/Text Messaging program:

  • Express Written Consent: By opting in, you consent to receive messages from RM SUPPORT.

  • Identification & Purpose: Every message sent will clearly identify RM Support as the sender and state the purpose of the communication (e.g., delivery updates, service alerts, or program information).

  • Opt-Out Mechanism: You may opt out of receiving text messages at any time by replying "STOP" to any message you receive. We will process your request immediately and send a one-time confirmation of your unsubscribe status.

  • New York Telemarketing Compliance: In accordance with New York State law, RM Support treats unsolicited texts as prohibited telemarketing. We will never sell, rent, or share your phone number with third parties for their own marketing purposes without your explicit consent.

  • Quiet Hours: To respect your privacy, RM Support will only send marketing-related messages between the hours of 8:00 a.m. and 8:00 p.m. EST, in compliance with NYS General Business Law.

  • TCPA Compliance: Our messaging program complies with the Telephone Consumer Protection Act (TCPA). We do not use prohibited automated or pre-recorded voice technologies for marketing without your specific authorization.

  • Message & Data Rates: Standard message and data rates from your carrier may apply.
     

Privacy
 

Our use of your personal information, including your mobile number, is described in our Privacy Policy. By using this site or our services, you agree that we may collect, use, and share information as described in that policy and in compliance with HIPAA and NYS Confidentiality Laws.
 

Privacy and HIPAA Compliance
 

In New York, your health information is protected by both Federal HIPAA regulations and the New York State Confidentiality Laws.

  • Our collection and use of your Personal Health Information (PHI) are governed by our Notice of Privacy Practices.

  • By using our services, you acknowledge that we may share necessary data with your Managed Care Plan and the NYS Department of Health for billing and coordination of care.

All content on this website—including text, graphics, logos, and software—is the property of RM Support or its licensors and is protected by U.S. and International copyright laws. You are granted a limited, non-exclusive license for personal, non-commercial use only.
 

Disclaimers
 

  • "As Is" Basis: To the extent permitted by New York law, our services are provided "as is" without warranties of any kind, either express or implied.

  • Availability: We do not guarantee uninterrupted access to our website or that specific meal options will always be in stock.
     

Limitation of Liability
 

To the fullest extent permitted by New York law:

  • RM Support, its officers, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

  • We are not liable for delays caused by third-party delivery services, extreme New York weather conditions, or actions taken by your insurance provider.

  • Our total liability for any claim shall not exceed the amount paid (if any) for the specific service giving rise to the claim.
     

Indemnification
 

You agree to indemnify, defend, and hold harmless RM Support from any claims, damages, or expenses (including attorney’s fees) arising out of your breach of these Terms, your misuse of the services, or your violation of any third-party rights.
 

Governing Law and Venue
 

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in New York Bronx County, New York.
